LIABILITY WAIVER FOR PHOTO/ VIDEO SHOOTS:

  • Liability Release: Renters and participants must sign a waiver releasing the company from any injury or damage claims during the photo or video shoot. This waiver should also include any damage to personal property, including but not limited to, cameras, drones, or other equipment.

  • Supervision: A company representative will be present at all shoots to monitor the vehicle and ensure its proper use.

LIABILITY FOR DAMAGES:

  • Damage Inspection: A detailed inspection of the vehicle, including photos, should be done both before and after the rental. Renters must agree to cover any damages identified post-rental.

  • Authorized Operators Only: No renter or guest is permitted to operate the vehicle under any circumstances. The only authorized operator is the company chauffeur to eliminate liability for accidents caused by unauthorized drivers.

  • Vandalism & Misuse: Any damage due to vandalism or reckless behavior during rental (e.g., extreme or unsafe photoshoot conditions, or if the vehicle is driven by someone unauthorized) will result in the renter covering the repair costs in full.

INSURANCE TERMS:

  • Proof of Additional Insured: For corporate clients or photographers, they must provide proof of liability insurance, naming your company as an additional insured party during the rental period. This adds another layer of protection in case of accidents.

  • Security Deposit: A larger security deposit for higher-risk clients (those with shorter rental periods, high-profile events, or more expensive vehicles) could be a useful deterrent for damage and misuse. Consider refundable deposits starting at $5,000+ based on the vehicle’s value.

  • In Case of Accidents: Clearly outline the renter's responsibility in case of any damages during use. They should be responsible for the deductible, loss of rental income during repair, and any diminished value to the car due to repairs or replacements.

VEHICLE CONDITION AND LIMITATIONS:

  • Mileage Limits for Chauffeured Services: Although your vehicles will be chauffeured, there should still be mileage limits (e.g., a max of 50 miles per event). Any excess should incur additional fees.

  • Weather Conditions: Limit rentals for outdoor events based on severe weather conditions (e.g., snow, heavy rain) that could pose risks to the vehicle or increase accident chances. You can specify that the company reserves the right to cancel or reschedule due to weather.

ADDITIONAL POLICIES:

  • No Smoking or Pets: Smoking or bringing pets inside the vehicles is prohibited. Any violations will result in a significant cleaning fee.

  • Alcohol Consumption: Alcohol should not be consumed inside the vehicle during the rental period. Clarify that if there’s evidence of alcohol consumption (e.g., spills, stains), it will result in additional cleaning charges.

  • Event-Specific Policies: For high-profile events like weddings, an agreement could be signed that limits how the car can be used (e.g., no standing or sitting on the car, no props touching the vehicle), to prevent scratches, dents, or damages to paintwork.

PAYMENT & REFUNDS:

  • Cancellation Policy: A clear cancellation and rescheduling policy is crucial, especially for weddings. A non-refundable deposit of at least 50% of the rental fee should be required upon booking. Cancellations within a specified window (e.g., 30 days) should forfeit the full rental amount.

  • Refund Timelines: Clarify that refunds for security deposits can take up to 14 business days, particularly if there's a dispute regarding damages.

ADDITIONAL SERVICES:

  • Add-ons: Offer services like photography packages, décor around the car, or themed vehicle setups (flowers, ribbons) as add-ons.

  • Chauffeur Etiquette: Chauffeurs will follow a specific code of conduct to ensure professionalism. No requests that compromise the safety of the driver or vehicle will be entertained.
